Maine decided to legalize recreational marijuana on Tuesday, but don't go sparking up just yet!

The new law will take effect within 40 days, but it will be Aug. 8 before the regulations for marijuana-related business are set. Local authorities will issue licenses to establishments for onsite consumption and will have the power to regulate, limit or prohibit the operation of pot businesses.

Meanwhile, although it appears as though supporters have enough votes for the measure to pass, opponents are considering a recount request and more than 4,000 absentee ballots from overseas -- technically enough to alter the outcome -- have yet to be counted.

  • This law affects adults over the age of 21
  • Maine residents will be allowed to grow for personal use
  • You may grow up to 6 plants, and/or 12 immature plants
  • You may possess  up to 2 1/2 oz of herbal cannabis
  • The bill lets you smoke pot in a non-public place, and the same laws that apply to smoking tobacco apply to pot
  • There will be a 10% sales tax on retail pot along with a 5% state sales tax
  • You can transfer or furnish up to 2 1/2 oz to an adult over 21 with no payment of any kind
